Dammenberg Chocolate Shop Contract, Ordering, Delivery and Warranty Terms

Dammenberg.fi is an online marketplace operated by Gredon Invest Oy, where the seller of the products is Gredon Invest Oy / Dammenberg (Business ID 1838940-5). Gredon Invest Oy operates and is responsible for the Dammenberg.fi online marketplace.

The following terms apply to transactions between the Dammenberg online store and its customers.

Dammenberg.fi sells chocolate products to adult private individuals, hereinafter referred to as consumers, as well as to companies and organisations, hereinafter referred to as business customers, purchasing products for food consumption.

We are committed to complying with theFair Play Rulesand Electronic Commerce Rules of the Finnish Direct Marketing Association, as well as all legislation governing consumer sales.

Dammenberg.fi also sells chocolate products to consumers under the age of 18, provided that their legal guardian has consented to purchases being made from Dammenberg.fi.

  8. Products have a 14-day right of return, provided that the product is unopened, undamaged, free from defects and suitable for resale in its original retail packaging. The right of return does not apply to products including logo chocolates, printed boxes, pralines, truffles, chocolate figures or customised products.
  9. All returns must be sent as customer returns or delivered directly to our shop.
  10. The right of return applies only to unused products, as specified in greater detail below.

Detailed terms

1. Ordering

1.1. When placing an order, the customer must always provide:
a) The customer’s name, address, email address, postal address and mobile phone number.
b) Business customers must provide the company name, contact person, email address, postal address, Business ID and mobile phone number.

1.2. With each order, the customer agrees to the contract, ordering and delivery terms in force at the time of the order. The current terms are available on the Dammenberg.fi website.

1.3 The Dammenberg.fi customer register is confidential. Dammenberg.fi undertakes not to disclose customer information to any parties other than those mentioned in this agreement.

1.4 Communication between the parties takes place by email or telephone. After placing an order, the customer agrees to monitor their email. The contact details for Dammenberg.fi are available at:

1.5 After an order has been placed, Dammenberg.fi automatically sends the customer the telephone number and email address of the person handling the order. The customer may then contact the order handler directly regarding matters such as changes to the order, cancellation or delivery time.

1.6 A binding sales agreement comes into effect when the customer places an order. The system automatically confirms the order by email or text message.

1.7 We reserve the right to restrict the sale of products in larger quantities, for example due to limited availability during seasonal delivery periods.

1.8 Dammenberg.fi’s liability in cases of poor product availability or restrictions imposed by authorities or import regulations is limited to cancelling the transaction and refunding any amounts paid in advance.

1.9 All products sold through Dammenberg.fi are sold as described. Please carefully review the product information on our website or the contents of the packaging when purchasing from our shop.

1.10 When the customer does not accept the contents of a product package, the product must be returned to Dammenberg within the 14-day return period and in accordance with the return terms.

1.11 In cases of obvious product or pricing errors, Dammenberg.fi may claim that an error has occurred, particularly when the error is so apparent that the customer should reasonably have understood that the information was incorrect.

1.12 Dammenberg.fi is responsible for the information and product details presented on its website.

1.13 Dammenberg.fi reserves the right to select its customers.

2. Prices

2.1 Prices shown in the price list include value-added tax but do not include delivery costs.

2.2 Free or discounted delivery may be available for certain products or when the total order value exceeds a specified amount. The shopping cart automatically applies any applicable delivery discount.

2.3 When the price of a product increases after an order has been submitted, the ordered products will be sold at the price valid when the order was placed. However, when changes are made to the order, the product price will be determined according to the price valid at the time of the change. When the price has decreased, the product will automatically be supplied at the new, lower price.

2.4 Product information for all products is available on our website. A return resulting from incorrect product information is free of charge when submitted as a customer return. The return must be made within a reasonable period after the error was discovered or should reasonably have been discovered. The customer is responsible for identifying the error within a reasonable period.

2.5 In cases of obvious pricing errors, Dammenberg.fi may claim that an error has occurred, particularly when the error is so apparent that the customer should reasonably have understood that the price was incorrect. For example, this may apply when a chocolate basket worth 40€ is accidentally offered for 4€.

3. Delivery

3.1 Dammenberg.fi delivers products to its customers with an average processing time of 5–8 working days. Pralines and logo chocolates have a longer delivery time, usually approximately 2–3 weeks. The product’s normal transportation time must be added to this. For example, Matkahuolto usually delivers parcels within 1–2 days, and Lähelle parcels within 2–3 days to the selected delivery location. We aim to inform the customer if the product’s processing time is longer than 12 days. Some seasonal products, special-order products or new products may have a longer delivery time depending on demand. Dammenberg reserves all rights to change delivery times, taking the above circumstances into account.

3.2 The consumer has the right to cancel the order at any stage, including when the order has already been processed. If the consumer does not wish to collect or redeem the order from Matkahuolto or the collection shop, it is recommended that they notify Dammenberg.fi. Order cancellations are recommended to be made by email using the customer’s order reference number.

3.3 During the transportation of the goods, Dammenberg.fi is responsible if the goods are damaged or lost during transportation. During the transportation of goods from the customer to Dammenberg.fi, the customer or Matkahuolto Oy is responsible if the goods are damaged or lost during transportation. In consumer sales, Dammenberg.fi is responsible for damage to the goods in all cases.

3.4 If the customer sends product returns, they must always remember to retain the return documents and the Matkahuolto receipt copy/tracking number. A complaint can also be sent by email to: myynti@dammenberg.fi

3.5 The poor availability of one product does not oblige Dammenberg.fi to reserve other products in the same order. We require that products that are immediately available in the order must be deliverable to the consumer no later than three weeks after the order, and the consumer must accept either the later delivery of the poorly available product or the cancellation of the product order. Delivery costs for later deliveries are charged normally.

4. Payment terms

4.1 An up-to-date list of payment methods can be found at the bottom of the page http://www.dammenberg.fi/ .

4.2 Companies, municipalities and the state have the option to purchase by invoice. We also sell to municipalities, the state, educational institutions and large companies by invoice when necessary (14 days net). For other companies and sole traders, we deliver against advance payment and only later by invoice once an established business relationship has been formed.

4.3 A condition for selling by invoice is always that the company’s latest income statement and balance sheet have been submitted to the Finnish Patent and Registration Office. Private individuals are always sold to by bank transfer, credit card or debit card.

4.4 There is no need to apply separately to become an invoicing customer; we verify credit information in connection with every order. If you have not purchased from us before, first provide us with written authorisation from your employer confirming your right to make purchases by invoice (for example, by fax or post), unless you are a member of the company’s board. Check whether the delivery you received includes an invoice. If the delivery you received does not include an invoice and you do not receive one by post within five working days, contact Gredon Invest Oy’s invoicing department (tel. 03 367 0080, email: myynti@dammenberg.fi)

4.5 If your employer pays for the order by invoice or the delivery address differs from the billing address, provide us with a freely worded authorisation as a copy by email (myynti@dammenberg.fi) or by post, but still place the order online. Remember to mention the name of the order handler in the authorisation.

4.6 By sending us the information specified above immediately after placing the order, you ensure the quick processing of the order.

4.7 Money paid in advance or through online payment must have been paid before the delivery is dispatched.

4.8 Some payment methods may require registration as a customer.

4.9 When paying in advance, by bank transfer, credit card or online payment, we require the order to be paid immediately. Unpaid orders will be cancelled.

5. Return policy

5.1 We offer a 14-day right of return and exchange from the time a postal parcel or collection order is collected (including weekends and public holidays, excluding the collection date). The product must be returned or exchanged no later than the working day following the 14th day. For example, if the 14th day is a Saturday, the product must be returned to Matkahuolto or brought to the collection shop no later than Monday. For example, if you ordered the products on 1 December and received them on 12 December, the final return date is 27 December. However, as this is a public holiday, the return must be made no later than 28 December.

5.2 The right of return for products sold through the online store applies only to unused products that are suitable for resale. During the return period, the consumer has the right to inspect and try the product in the same way as they could when purchasing the item from a shop. The consumer may not open the packaging to inspect and try the goods without losing their right of cancellation. They may also not take the goods into use because they are food products.

5.3 The right of return never applies to, among other things, an opened box or praline box, printed boxes, personalised wedding orders or any other product manufactured to order and personalised according to the customer’s wishes.

5.4 The online store’s right of return applies only to unopened, unused and fully saleable packaged products.

5.5 However, the online right of return does not apply to the following products: logo chocolates, engraved chocolates, pralines, truffles, logo-printed chocolates, products customised according to the customer’s wishes.

5.6 Business customers have no right of return or order cancellation at all for certain products.

5.7 Returns are free of charge for consumers. We use Matkahuolto’s customer return service. Always use the Matkahuolto customer return form.

5.8 The purchase or collection date is considered to be the date on which the parcel was redeemed or collected, or alternatively the date on the receipt. The customer is responsible for proving the date on which the parcel was collected from Matkahuolto, for example with a receipt.

5.9 If, in exceptional circumstances, we accept the return of a product that is unsuitable for resale, incomplete or returned after the return period, we will charge our costs, amounting to at least 50% of the product’s price.

5.10 Product returns must always be:
a) In the original packaging (properly packed and unopened) without unnecessary markings
b) Accompanied by a copy of the receipt/delivery note.
c) Accompanied by a completed warranty and return form (available from the website www.matkahuolto.fi/).
d) No later than 14 days after the time of purchase.

5.11 We do not accept unpaid or credit parcel shipments, returns or any shipments sent by any method other than Matkahuolto. Returns can be made either by bringing the product to us or through Matkahuolto’s customer return service, which is free of charge for the sender. Products purchased from the shop can only be returned to the shop.

5.12 When sending us something, remember to protect the parcel well. By using the original packaging and protective material for the return, you help ensure that the product arrives undamaged. We do not accept a product return if the consumer has completely failed to follow the packaging instructions on the return form. Damage to a return caused by Matkahuolto is the responsibility of the seller, Dammenberg.fi.

5.13 We charge the customer for unjustified returns according to the current price list. Searching for a defect in a defective product from a multipack is a paid service. We also charge costs arising from analysis by a third party.

5.14 Products that have been returned or sent incompletely (see the instructions above) will be sent back at the customer’s expense.

5.15 The right of return is always product-specific, and a possible delay in the delivery of another product does not entitle the customer to a longer return period for another product.

5.16 The customer must pay the costs of returns made from abroad.

5.17 Customised products and products manufactured to order do not have a right of return.

6. Warranty / Shelf Life

6.1 All products have a warranty in accordance with food legislation. The warranty covers the observable and consumable quality and shelf life granted by the manufacturer when the products have been stored according to the manufacturer’s instructions at the correct temperature of +10–20 degrees. Chocolate products must always be kept in a sealed bag or airtight container, in a dry place and away from strong odours and other substances that affect flavour.

6.2 Dammenberg.fi is responsible for the warranty it provides.

6.3 The shelf life is calculated from the manufacturing date on which the product was produced. It can be determined by counting 6, 12, 15 or 18 months backwards from the best-before date, depending on the product.

6.4 All returns will first be inspected and tested when necessary. A condition of the warranty is that the product has been stored and handled according to the manufacturer’s recommendations and instructions. Dammenberg.fi may be released from warranty liability if we can demonstrate that the deterioration or damage to the product was caused by an accident, incorrect use of the goods, storage or another circumstance attributable to the buyer. Similarly, if it is later established, for example by the manufacturer or an analyst, that the product was damaged because of the customer’s negligence, we have the right to charge the resulting costs.

6.5 The warranty does not cover tasting the product or any subsequent reactions resulting from it if, at the time of purchase, the customer was not aware of the characteristics of the product being purchased, even though they were available to read for every product at the time of purchase. Complaints caused by incorrect storage and/or the resulting deterioration of the product are not covered. Because the products are food products, the warranty does not cover deterioration or damage resulting from failure to comply with the normal handling conditions required for food products or from negligence.

6.6 If the product has been damaged due to any of the circumstances mentioned in Sections 6.3, 6.4 or 6.5, the product will be returned to the customer, and the customer will be charged the processing fee and delivery costs valid at the time.

6.7 In accordance with the Consumer Protection Act, the buyer must notify the warranty provider of a defect immediately when the buyer discovers the defect or should have discovered it.

6.8 We do not accept unpaid, cash-on-delivery or credit parcel shipments (returns or complaints) or any shipments through Posti. Returns or warranty shipments must be made either by bringing the product to us or through Matkahuolto’s customer return service, which is free of charge for the sender when sent from Finland. When using other delivery methods or sending from abroad, we are not responsible for the delivery costs.

7. Delivery and product information errors and complaints

7.1 Read our complaints page at http://www.dammenberg.fi/, where you will find detailed instructions on how to proceed with, among other things, lost parcels or product returns. You can also submit complaints about other matters.

7.2 In accordance with the Consumer Protection Act, the buyer must notify the warranty provider of a defect within a reasonable time after the buyer discovered the defect or should have discovered it.

7.3 The customer has the opportunity to receive compensation for a reduced price within 14 days. In this case, send us a written complaint, for example by email (palaute@dammenberg.fi) or by letter (Suklaatehdas Dammenberg, ‘complaint’, Varastotie 1, 33880 Lempäälä). The complaint must be sent to us within 14 days of the time of purchase (including public holidays and weekends). The complaint must include a copy of the purchase receipt (a version received by email is also acceptable), the receipt number and the customer’s bank account number. Incomplete or late complaints will not be processed. The processing time for complaints is usually 2–4 weeks. The amount of the complaint, meaning the amount to be compensated, must be at least €17; complaints for smaller amounts will not be processed.

7.4 It is always recommended that all cancellations of sales and discounts be agreed in writing (for example, by email or letter). Cancellations or discounts agreed by telephone may be difficult to check or verify afterwards.

7.5 Products shown in product images may differ from the product offered or include products that are not included with the product.
